これは当然の判決に見えますね。そもそも生成AIの学習データと著作権に関する議論では、生成データは学習データへの直接の依拠性がない前提の論陣を張っていたりもするので、そちらとの整合性という意味でも当然。
まぁ後者の議論の場合は生成データの依拠性以前に利用許諾契約違反やら著作物の不正利用がどうなんだ、というそれ以前の点が問題なんだと思いますが…(日本の30条の4が明確に「不正利用OK」という答弁を残しているのがあまりにもおかしい)。
