Looks like the FDA—the actual *defendant* in the mifepristone case—isn’t filing *anything* in #SCOTUS respecting the emergency applications from Danco and GBP.
It’s wild that DOJ is taking no position on whether a federal regulation should or should not be blocked for the duration of this case…
