Under Heck v. Humphrey (1994), an unlawfully prosecuted plaintiff can win damages only if “the conviction… has been reversed on direct appeal.” Cato brief argues that the Heck bar should not apply where the plaintiff never had access to federal habeas relief or seeks purely prospective relief.
